How the CMS Calculates the Maintenance you Should Receive

There are two legacy child maintenance systems in existence both of them are running down as the Child Support Agency transfers cases to the Child Maintenance Service but knowledge of the systems will remain necessary in cases where arrears are challenged and a recalculation is made.  The system was then run according to the date the case began, if your case began prior to March 2003 then your case was CS1, an algebraic formula, if your case commenced after March 2003 then it was calculated under the fixed percentage formula but all cases are now conducted on the CMS formula however the old systems are important where they have generated arrears, put simply the three systems work as follows:-

CS1 – The Algebraic Formula

CS2 – The Fixed Percent System

CS3 – The CMS System
